OCU Contract Ratification

Update 44 – April 18, 2013 / 1031 hrs (10:31am):

  • USMX has ratified the new contract yesterday

Update 43 – April 10, 2013 / 1047 hrs (10:47am):

  • The master contract, covering the 14,500-plus waterfront workers, was ratified yesterday by the ILA
  • Following this, the USMX will have a ratification vote on April 17

Update 42 – April 5, 2013 / 1012 hrs (10:12am):

  • Upcoming dates:
    • April 9 – ILA Ratification vote
    • April 12 – NYSA Ratification vote for local
    • April 17 – USMX Ratification vote, which will be for the full group of employers (The USMX Bargaining Committee voted yes)

Update 41 – March 13, 2013 / 1754 hrs (05:54pm):

  • The two sides met today and agreement has been reached on the terms for a new master contract
  • The contract will now go before the over 14,000 members of the ILA and the members of the carriers, terminal operators, and port associations that make up the USMX

Update 40 – March 8, 2013 / 1018 hrs (10:18am):

  • On Thursday, March 7, 2013, a tentative deal was reached between the NYSA and local ILA at the Port of NY/NJ
  • Completion of local bargaining is a key step in the overall East/Gulf Coast master contract negotiations
  • USMX and the full ILA bargaining committee are scheduled to meet next week, March 13-14, to review outstanding master contract issues
  • These negotiations remain fluid

Update 38 – February 21, 2013 / 0700 hrs (07:00am):

  • The OCU has ratified the contract agreements
  • There is no further threat of a strike
  • After 34 months of negotiating, the process is complete

Update 37 – February 8, 2013 / 1140 hrs (11:40am):

  • The OCU held a ratification vote on all of the contracts on February 6, 2013
  • The official results of the vote have now been formally communicated to the employers
  • The tentative agreement reached on December 4, 2012, was not ratified by the OCU at any company, including Maersk Line
  • The ports of Los Angeles and Long Beach continue to operate normally
  • We will continue to keep you posted on developments

  • The ratification vote took place last night and some of the contracts were rejected by the OCU
  • We are monitoring the situation closely and as soon as we have factual information we will let you know

Update 35 – January 29, 2013 / 1032 hrs (10:32am):

  • Along with other OCU employers in the Ports of Los Angeles and Long Beach, on December 4, 2012, Maersk Line reached an agreement with the OCU for a contract that will run through June 30, 2016
  • The OCU plan to hold a ratification vote on all of the contracts on February 6, 2013

Update 18 – November 30, 2012 / 1640 hrs (04:40 pm):

  • Majority of terminals at Port of Los Angeles/Long Beach remain closed
  • ILWU continue to honor OCU pickets
  • TraPac and SSA Pier A are fully operational and are working all cargo including Maersk Line.
  • All other terminals that employ OCU labor remain closed
  • All inland BNSF rail facilities moving cargo to the Los Angeles/Long Beach area are receiving US export cargo, however all cargo intended for Los Angeles/Long Beach are being grounded and trains are no longer departing Los Angeles/Long Beach

  • Maersk Winnipeg (voyage 1227) – vessel will skip its Los Angeles call and proceed to Lazaro Cardenes, Mexico, instead of Manzanillo.  US export cargo will be rolled to the Maersk Westport (voyage 1227).  US import cargo for Los Angeles will be discharged in Lazaro Cardenes, Mexico.  Connection is planned with the next TP7 Maersk Drury
  • CMA CGM Vivaldi will not discharge cargo at Long Beach Pier J, instead of Long Beach Total Terminals International (TTI)

Update 17 – November 30, 2012 / 1427 hrs (02:27 pm):

  • Both sides will meet this afternoon to continue bargaining
  • Majority of terminals at Port of Los Angeles/Long Beach remain closed
  • Chicago Rail:  US export cargo still gating in at BNSF Logistics Park.  However, all cargo now being grounded and no longer sending out new trains until there is resolution in Los Angeles/Long Beach
  • Houston Rail:  Still accepting exports through the gate at APMT however no trains are being sent to Los Angeles/Long Beach until there is resolution in Los Angeles/Long Beach
  • All other inland rail locations operating as normal

Vessel Updates:

  • Maersk Winnipeg – The cargo diverted to Manzanillo, Mexico from the Maersk Winnipeg is now going to be picked up via inducement call of the TP7 service’s Maersk Drury (voyage 1302).  Maersk Drury TP7 service ETA into Los Angeles is December 8.  If labor action continues in the Los Angeles area, we may have to revert back to original contingency to connect to the Susanna Schulte (voyage 1220) ETA December 12
  • Bay Bridge Service currently being worked at Pier A and estimated to be on time in Oakland

Update 16 – November 30, 2012 / 1131 hrs (11:31 am):

  • All BNSF trains from Houston to Los Angeles/Long Beach have stopped.  For all inland locations other than Houston, BNSF continues to release westbound traffic
  • Cargo bound for inland destinations discharging at Pier A and TraPac continue to move.  All other inland cargo will not move until terminals return to normal operations

Vessel Update:

  • Vessels en route to Los Angeles/Long Beach continue to sail at slower speed
  • No current plans to divert incoming vessels

Update 15 – November 30, 2012 / 0644 hrs (06:44 am):

  • Both sides met last night, November 29, and adjourned without resolution
  • They plan to meet again today, November 30
  • Pickets will remain up so Terminals will stay closed

Update 14 – November 29, 2012 / 2247 hrs (10:47 pm):

  • Both sides to meet this evening, November 29
  • The ILWU Local 63 Marine Clerks Office Clerical Unit (“OCU”) remains on strike at terminals in the Ports of Los Angeles and Long Beach
  • ILWU longshore locals continue to honor the OCU pickets and operations are completely shut down at ten (10) of the fourteen (14) terminals in the ports
  • TraPac and SSA Pier A are fully operational and working all cargo including Maersk Line.
  • All other terminals that employ OCU labor remain closed
  • US export cargo bound for Houston continues to move via rail out of the BNSF Hobart facility in downtown Los Angeles

Vessel Update:

  • SL Comet (voyage 1219) – remains alongside Pier 400
  • Mette Maersk (voyage 127N) – remains alongside Pier 400
  • Maersk Winnipeg (voyage 1227) – vessel will skip Los Angeles call and proceed to Manzanillo.  US Export cargo will be rolled to the Maersk Westport (voyage 1227).  US Import cargo for Los Angeles will be discharged in Manzanillo, Mexico.  Connection is planned with next northbound WCCA vessel Susanna Schulte (voyage 1220).  Subject to change

Vessel Update:

  • SSA Pier A is gating/working Maersk cargo
  • Status of TP5 and TP6 remain unchanged; vessels remain dockside
  • Maersk Winnipeg (voyage 1226) will omit Pier 400 Los Angeles and has been diverted to Manzanillo, Mexico
  • Export bookings for the Maersk Winnipeg (voyage 1226) will be rolled to the Maersk Westport (voyage 1227).  This will delay the cargo by one (1) week.  Cargo for Corinto, Nicaragua will be discharged in Balboa, Panama and connect with the Orion (voyage 1261)
  • Import bookings currently on the Maersk Winnipeg (voyage 1226) for Los Angeles will be discharged in Manzanillo, Mexico.  Connection is planned with next northbound WCCA vessel Susanna Schulte (voyage 1220).  These shipments will be delayed one (1) week
  • All other inbound vessels have been slowed down; we will provide updated ETA as soon as available

Update 12 – November 29, 2012 / 1300 hrs (01:00 pm):

  • Port is fully shut down as of twenty-two (22) hours ago (APMT forty-six (46) hours ago)
  • No bargaining scheduled
  • Federal government is not involved
  • TraPac and SSA Pier A are fully operational and working all cargo including Maersk Line
  • At SSA Pier A the TP2 MSC Rachelle import cargo has been discharged and export cargo is now being loaded.  Currently unclear if they are gating Maersk cargo.  Most recent update is that they are, however SSA has agreed with the union they would not gate Maersk cargo
  • At TraPac the PSW service is being worked.  Gates are open for all cargo
  • All other terminals are not working

Vessel Update:

  • Maersk Winnipeg – anchored off the coast; now being diverted to Manzanillo, Mexico
  • All vessels en route to Los Angeles/Long Beach have been slowed down

Update 11 – November 28, 2012 / 1900 hrs (07:00 pm):

  • All Office Clerical Unit (“OCU”) employed at agency offices walked off the job at noon Pacific Time
  • All marine terminals in the port that employ OCU were shut down with OCU pickets established at the gates
  • Those terminals not employing OCU labor are fully operational
  • SSA continued to refuse acceptance of Maersk slot-charter cargo at their gates
  • Unknown at present if grievance went to the Coast Arbitrator

Update 10 – November 28, 2012 / 1640 hrs (04:40 pm):

  • APM Terminals Pier 400 remains closed
  • OCU has walked out at other locations within the harbor

The following services for Pier 400 are impacted and delays to cargo delivery should be expected:

  • SL Comet (voyage 1219)
  • Mette Maersk (voyage 127N)
  • Maersk Winnipeg (voyage 1227)
  • Rail cargo leaving Pier 400:  not moving as the terminal is closed
  • Rail cargo arriving Pier 400:  will be held at the Pier 400 support yard

Update 9 – November 28, 2012 / 1422 hrs (02:22 pm):

  • PMA and the ILWU reached a disagreement at the Coast Labor Relations Committee (LRC)
  • PMA is now attempting to move the issue to the Coast Arbitrator

Update 8 – November 28, 2012 / 1245 hrs (12:45 pm):

  • Pier 400 is shut down by Office Clerical Unit (“OCU”) pickets
  • The ILWU continues to refuse to honor the Arbitrator’s back to work order
  • The PMA and ILWU started a Coast Labor Relations Committee (LRC) at 0900 hrs (9:00 am) Pacific Time where they will address the ILWU’s refusal to return to work.  The issue will then proceed to the Coast Arbitrator
  • Long Beach Terminals are not impacted at this time, with no other terminals in Los Angeles are impacted at this time

Update 7 – November 28, 2012 / 0745 hrs (07:45 am):

  • The local arbitrator ruled that the pickets were non bona fide and ordered ILWU labor back to work
  • The ILWU did not adhere to the ruling which is now being addressed as an illegal work stoppage
  • The issue will now move to Coast Arbitrator morning Pacific Time
  • If not resolved by Coast Arbitrator ruling, the next step is a Federal Court injunction
  • The Office Clerical Unit (“OCU”) remains non-working
  • Pier 400 remains shut down

Update 6 – November 27, 2012 / 1716 hrs (05:16 pm):

  • At noon Pacific Time the Office Clerical Union (“OCU”) workers established pickets at Pier 400
  • At 1230 hrs (12:30 pm), APMT Pier 400 was notified that the ILWU would honor the pickets
  • All operations have stopped at Pier 400 – this includes both vessel and rail operations
  • Truckers are not being allowed into the terminal
  • APMT Pier 400 remains the only terminal impacted
  • An arbitrator has been called and the grievance process is underway, with a decision estimated to come down prior to 2000 hrs (8:00 pm) Pacific Time

The following Maersk Line services are currently in port at Pier 400:

  • SL Comet (voyage 1219) ETD November 28 @ 0300 hrs (3:00 am)
  • Mette Maersk (voyage 127N) ETD November 27 @ 1700 hrs (5:00 pm)

Due to come in tomorrow, November 28 is the:

  • Maersk Winnipeg (voyage 1227) ETA November 28 @ 0800 hrs (8:00 am)

Update 5 – November 27, 2012 / 1534 hrs (03:34 pm):

  • The Office Clerical Unit (“OCU”) have posted pickets and have blocked truckers from entering the APMT Pier 400 facility

Update 4 – November 27, 2012 / 0951 hrs (09:51 am):

  • Informed negotiations broke down yesterday, November 26
  • Currently, there is no indication of labor action pending

Update 3 – November 23, 2012 / 0014 hrs (12:14 am):

  • The Office Clerical Unit (“OCU”) has requested a meeting to discuss the status of bargaining with the Harbor Employers Association (“HEA”) Board
  • Meeting expected to occur Monday, November 26
  • Normal operations remain in effect

Update 2 – November 21, 2012 / 1801 hrs (06:01 pm):

  • Operations remain normal

Update 1 – November 20, 2012 / 1929 hrs (07:29 pm):

  • On the evening of November 19, the Office Clerical Unit (“OCU”) and Harbor Employers Association (“HEA”) terminate contract bargaining
  • No word of strike
