MLL Advisory – HS Code Guidelines – Improved Alignment with Cargo Preference

The United States Maritime Administration (MARAD) was established to manage the “Cargo Preference program work to promote and facilitate a US maritime transportation system that is accessible and efficient in the movement of goods and people. It oversees the administration of and compliance with US Cargo Preference laws and regulations. Those laws require shippers to use US-Flag vessels to transport any Government-impelled oceanborne cargoes.”

As a participant in both the Maritime Security Program (MSP) and Voluntary Intermodal Sealift Agreement (VISA) program, a primary focus of Maersk Line, Limited is handling the transportation needs of US Government customers in accordance with Cargo Preference rules and regulations. As mentioned in our previous announcement regarding compliance, Maersk has made process changes that will isolate US Government cargo from commercial cargo to ensure proper handling.

In better aligning with MARAD’s Cargo Preference laws, Maersk has created HS codes that will simplify the booking process and provide Maersk and our customers’ better transparency concerning US Government cargo.

Starting October 1, 2016 all shipments of US Government cargo must be booked with one of the below HS codes. It is important to note that these new descriptions must be referenced or selected during the booking process, in order to ensure the appropriate association for a given shipment.

MLL Advisory – Compliance is Essential for US Government Customers

As mentioned in our earlier announcement, Maersk has made enhancements in how we service you – a customer that participates in US Government business. One of most important drivers influencing these changes is our ongoing commitment to compliance due to its significance in Government contracting.  Committing to compliance reduces the likelihood of contractor wrongdoing, both as a prime and/or sub-contractor, and thus the risk of potential legal implications.

To help us better comply with the unique requirements associated with Government contracting such as: FAR (Federal Acquisition Regulations) and sub-contractor flow-downs, Maersk has established regional FST’s (US Flag Support Teams) that have been specifically trained on how to properly execute US Flag impelled cargo. These teams are located in the United States, the Netherlands, and Bahrain to ensure truly global support for our US Government customers.  Maersk’s specialized US Flag Support Teams (FST) will assist you with your daily shipment activities such as cargo tracking, documentation coordination, issue resolution/escalation, and any other customer service relevant matters.

In addition to the creation of specialized teams, we have made process changes that will isolate US Government cargo from commercial cargo to ensure proper internal handling of these shipments. This initiative, which will be driven by HS code, will be rolled-out in October 2016 in conjunction with enabling our web-platform for our US Government customers.  The specific changes will be announced later this week, so please be on the lookout for a follow-up announcement.

Turkish Holiday Schedule Impact on DOD Cargo Shipments

Please be advised of the upcoming Turkish holiday schedule that could impact cargo movement planning and execution.

Below is a list of Turkish holidays; during these times Turkish Government offices will be closed. The Turkish Government usually extends the holidays for Government employees through the end of the week. Based on the following holiday schedule, USAFE-AFAFRICA anticipate movement and delivery delays with import cargo shipments to Turkey. Turkish Customs at Incirlik AB will work during holidays to clear aircraft parts and general cargo that arrive on military aircraft (MILAIR). Recommend all MICAPs/999 shipments to be routed via MILAIR to avoid delays.

Istanbul will not clear cargo through customs and commercial carriers will be closed as well. Diyarbakir (Site D) requests no MILAIR or commercial carriers arrive/depart during this time due to Turkish Customs access to the installation. Commercial carriers will not be allowed on the installation during the following periods.

ML Advisory 2016 – 35: Eid Al Adha (EID) Holiday Impact

Be Advised: Eid Al Adha, the Feast of the Sacrifice, the second of two major religious festivals celebrated by Muslims, will tentatively begin on 11 Sep 2016 and end on 13 Sep 2016. The actual dates may vary in each country depending on the region.


Pakistan (PAK GLOC): Eid Holidays will be observed in Pakistan for 3-4 days as declared by Government of Pakistan, depending on moon sighting. During this holiday: Customs; National Logistic Cell (NLC); Borders and all Port Operations will be closed for 3 days. Historically truck drivers usually leave for their hometown or villages to celebrate Eid 10 days prior and with an anticipated return 7 days post Eid.

During these days, import cargo will remain at port. Dispatches of import cargo from port to Afghanistan will resume beginning 7 days after the holiday. Truck availability will remain short a week prior to Eid and the week after Eid. Normal operations will resume on or about 21 Sep 16. Cargo at the port will be cleared for dispatched from the port no earlier than
9 Sep 16 after receiving TAP from NLC.

Afghanistan: Government offices in Afghanistan will close 2 days prior to Eid and will remain closed for 10 days to include the border crossing points, with limited to no cargo movement. Documentation/Customs teams will remain active until 7 Sep 16 and close during Eid and re-open after Eid.

Ground movement is anticipated to be affected from 8 Sep 16 and will resume by 18 Sep 16. During this time, there will be no intra-Afghanistan trucking so there will be delays on cargo dispatch. Truck placement at bases will stop 5 days prior to Eid. Dispatches from Afghanistan to Pakistan will stop from South (Chaman) 10 days prior to Eid. Dispatches from Kabul to Kandahar (APPF dependent highway) and Spin Boldak will also stop 3-5 days prior to Eid (and vice versa). Any cargo arriving from Pakistan during holidays will be staged at Carrier Holding Yard (CHY) facilities. There will be no Afghanistan Public Protection Force (APPF) escorts tentatively from 12-14 Sep 16.

Import cargo already en-route will be stored at a secured holding yard. Multimodal cargo that is flown into Afghanistan will be held at the airfield until trucking resumes. Cargo will be flown into Afghanistan on schedule and will not be staged in the UAE.

Export cargo will also be held at the FOB until trucking resumes. Cargo already en-route will be stored at a secured holding yard. Multimodal cargo at airbases will be flown to and dispatched as scheduled taking into account Environmental Health & Safety (EHS)/Criminal Investigation Department (CID)/Dubai Port Security (DPS) being closed and subject to MOD being approved.

United Arab Emirates (UAE): UAE Customs and Port Operations will be closed for 4 hours for prayers on the first day of Eid and will be fully operational at all other times (working on overtime/rotation basis) but EHS & UAE Ministry of Defense (MOD) will be closed during the holidays. MOD will stop receiving MOD requests for approval. This will have a negative impact on both C-17 and commercial flights arriving to Al Maktoum International Airport.

With regards to the air portion, there will be no potential impact on the operations during the Eid Holiday. General Dubai World Center (DWC) Airport operations could be slowed to include delay in obtaining EHS Inspection and MOD processing due to low manpower in observance of the holidays. UAE Government sector normally gets a 10-day holiday including the weekends. Only the custom documentations/MOD applications will be effected during this period.

Jordan: Port operations will stop on the first day of Eid and resume normally the next day. Import and export cargo can be staged or loaded directly on trucks en-route to the inland points during Eid except for the first day of Eid as stated above. General Headquarters (GHQ) Jordanian Armed Forces (JAF) and International Affairs will be closed during Eid. No Customs Memos will be processed.

Inland transportation will not be affected; they will only stop for breakfast. For Wash Rack Ops – washing would be at 0730 till 1500, and resume at 2100 until 0600 next day. Commercial Seaport will start at 0600 until 1500 and resume at 2100 until 0500 the next day. No delays at the airport except for the breakfast time. These timings apply for all operations (loading, discharging, washing, loading/unloading the trucks, etc.).

Oman: Customs department will be closed from 8–14 Sep 16. Vessel and cargo movement will carry on as usual.

Kuwait: Port will be closed for 1-2 days with no delivery nor receipt of cargo. Vessel operations will be normal. Customs will be closed as per Ministry’s declaration.

Customs related formalities for new shipments will be on hold until customs re-open after Eid. No delays/issues in dispatching import cargo as long as there is an approved AK-302 and no customs issues or sudden closure of port due to security reasons. Carriers shall submit Bill of Lading (B/L) to US Government (USG) at least 72 hours prior to vessel arrival to prevent delays in processing AK-302.

Containers in transit will be held at the closest port/yard/safe place during Eid holiday.

Iraq: Port operations will stop on the first day of Eid and resume normally the next day with skeleton staff and expected delays in operations. Customs and State Agency will be closed during the holiday. Normal operations and customs office will resume work on 16 Sep 16.

Vessel movement will carry on as usual. Delivery might be possible for cleared cargo depending on availability of trucks.

Bahrain: Terminal/Port Operations will have normal working hours however the customs service might be intermittent and other related services/ documents can be delayed.

Qatar: Port and Customs office will be closed the first day of Eid and will be fully operational at all other times (working on Overtime).

Saudi Arabia: Local government agencies including customs will be closed. Trucking will continue on a very slow phase provided the clearance has been completed prior to the holiday. Otherwise, trucking will commence after the holiday but still on a very slow phase for a week or two.

Egypt: During Eid, vessel movement will continue. Customs office will be closed. Export cargo arriving at the port during the holiday can be gated in. Terminals will take 1-2 days off.

ML Advisory 2016 – 28: Zika Virus – Fumigation Requirement

Efforts have been made from the U.S. Department of Agriculture (USDA) and Foreign Agriculture Service (FAS) officers to obtain information on China’s Zika policy. As a result, this morning, the USDA FAS published more details on this requirement which are briefly outlined below. This requirement – as it stands today – is the responsibility between the shipper or consignee and the China Inspection and Quarantine (CIQ) inspection offices.

Based on further guidance from the World Shipping Counsel (WSC) we understand that the China’s General Administration of Quality Supervision, Inspection and Quarantine (AQSIQ) officials, which is the agency releasing this policy, are not communicating directly with shippers and carriers, but are instead communicating the Zika policy through local China Inspection and Quarantine (CIQ) inspection offices.

We can now confirm that the Zika policy applies to shipments originating in and loaded in the United States and other Zika-affected countries. Shipments that pass through the United States without being loaded or unloaded (e.g. FROB cargo) are not covered by the policy. Also, we can confirm that while China’s Zika policy applies to shipments that departed the United States after August 5, ships that departed the U.S. prior to that date may be subject to treatment on arrival if any mosquitos or larvae are found.

ML Advisory 2016 – 30: MSDS Required for DG Shipments Bahrain (Imports & Exports)

Dear Valued Customer,

Please note we have been made aware that a MSDS (Material Safety Data Sheet) is required for all dangerous good shipments importing into, and exporting out of, Bahrain.

This is apparently not a new requirement; however, we are only now aware of the process. Note, we have not faced previous issues with shipments due to missing MSDS. To further ensure no issues with DG exports and align with the requirement, we will require all Shippers to provide a MSDS with their other hazardous documents effective immediately.

If, during the booking stage, we find a MSDS is missing, we will raise directly with OCCA SWA and the Shipper to send the document. Our internal Documentation SOP will be updated accordingly.

Implementation of Electronic Cargo Tracking Notice (ECTN) – Togo

Dear Valued Customer,

This advisory is to inform that it is a requirement for all cargo discharging into Togo have an Electronic Tracking Cargo Notice (ECTN). We will offer the service of organizing and providing this service to you, our customer. To provide this service, we will now request a One Time Offer (OTO) for all cargo discharging into Togo to account for administrative costs.

Implementation of OTO for ECTN in Togo:
Import: $200 per 20’ container; $300 per 40’ container
(Rates include processing fee and administrative cost to Carrier to coordinate and process the ECTN)

ECTN Import will be required for all cargoes discharging in Togo regardless of the final destination. The numbers are issued and logged electronically through (Antaser Afrique). Information is then available to Shippers and Forwarders in order to enhance Togo’s ability to identify high-risk cargo shipments.

Responsible Parties – Action Required:
Origin Maersk Line Flag Support Teams (FSTs) booking to a Port of Discharge in Togo will ensure Maersk Togo handles the ECTN via the Maersk Line subcontractor Necotrans. Necotrans has registration with and are able to arrange the ECTNs.

For short sea shipments (i.e. transit times of three (3) days or less) of containers/trailers/conventional/bulk shipments, the ECTN is required three (3) working days prior to the ship’s arrival at Lome, Togo.
For long distance shipments (i.e. transit times of greater than three (3) days) of containerized cargo, the ECTN is required no later than twenty-four (24) hours prior to loading the Port of Departure.

Required Documentation:
• Booking Document / Bill of Lading – to be provided by the Shipper
• Original Commercial invoice – to be provided by the Shipper
